Enforcement Mechanism under CPC

The Code of Civil Procedure, 1908 (CPC) allows certain foreign decrees to be enforced as if passed by Indian courts, following principles of res judicata when decided on merits and complying with specific conditions.

Section 13 CPC – Exceptions

  • Foreign judgment not by competent jurisdiction

  • Founded on incorrect international law or refusal to recognize Indian law

  • Obtained by fraud
  • Claim based on breach of Indian law

All foreign judgments must pass these six "tests" before being considered binding in India.

Participation of Respondent

If one spouse contests divorce in the foreign court, it\'s deemed acceptance of that court\'s jurisdiction. Ex-parte decrees (where the respondent isn\'t served) are generally not recognized in India and can be declared void. Decrees must be based on grounds available under Indian marriage law for parties married under Indian law.

Recognition of Foreign Decrees

  • Reciprocating Territories: Judgments from these can be enforced directly as if from Indian courts.
  • Non-Reciprocating Territories: Judgments require a separate suit in Indian courts to validate and enforce.

Non-Reciprocating Territories

For non-reciprocating countries, a suit must be filed in India for enforcement. The decree must satisfy Section 13 CPC tests, and must be filed within three years of the foreign judgment. Such judgments aren\'t immediately executable, but can be persuasive evidence for a domestic court decree.
